Section 04

Product and Service Information

+

4.1 Accuracy of Information

We take reasonable care to ensure that descriptions, specifications, prices and availability of goods and services shown on our website are accurate and up to date. However, minor differences may occur, including differences in packaging, component revision, manufacturer design, colour, layout or availability.

4.2 Technical Specifications

Computer components and specifications may vary depending on stock availability, manufacturer updates or supply chain conditions. Where substitution is necessary, KIBOPC will use reasonable efforts to provide an equivalent or superior component and, where appropriate, will seek customer approval before proceeding.

4.3 Images

Product images on the website are for illustrative purposes only. The final product may differ slightly from images shown, especially where a computer is custom-built or configured to customer requirements.

4.4 Customer Responsibility for Compatibility

Where a customer purchases individual components or requests specific hardware or software, the customer is responsible for ensuring that such goods or specifications meet their own compatibility, performance and usage requirements, unless KIBOPC has expressly advised otherwise in writing.

Section 05

Orders and Contract Formation

+

5.1 Placing an Order

An order may be placed through the KIBOPC website, by email, by written quotation acceptance, or by another method expressly accepted by KIBOPC.

5.2 Order as Offer

When you place an order with KIBOPC, you are making an offer to purchase the relevant goods or services in accordance with these Terms.

5.3 Acknowledgement of Order

Any automatic email, payment receipt, website confirmation or quotation acknowledgement does not constitute acceptance of your order. Such communications confirm only that we have received your order request or payment instruction.

5.4 Contract Formation

A binding contract between you and KIBOPC is formed only when KIBOPC sends you a Dispatch Confirmation email, or, in the case of services, when KIBOPC confirms in writing that the service booking has been accepted.

5.5 Right to Refuse or Cancel Orders

KIBOPC reserves the right to refuse, cancel or reject any order before contract formation, including where:

goods or components are unavailable;
pricing or product information contains an error;
payment is not authorised or is reversed;
the order appears fraudulent, abusive or unlawful;
the requested configuration is technically unsuitable, unsafe or impractical;
KIBOPC is unable to fulfil the order for reasons outside its reasonable control.

5.6 Custom Orders

For Custom-built PCs and other custom-made goods, KIBOPC may require written approval of the final specification and full or partial payment before sourcing components or beginning assembly.

5.7 Prepayment and Ordering of Components

Unless otherwise stated in writing, Custom-built PCs, made-to-order systems, special-order components and certain Ready-built PCs may be processed on a prepayment basis.

Where required parts or components are not physically held in stock by KIBOPC at the time of order, KIBOPC may order such components from suppliers only after the customer has confirmed the order and payment, deposit or agreed prepayment has been received.

Build, preparation or fulfilment time starts only once the required components have been received by KIBOPC and the final specification has been confirmed.

5.8 Ready-built PCs and Stock Availability

Ready-built PCs displayed on the website may be available from existing stock or may require component sourcing, final assembly, testing or preparation before dispatch or collection.

If a Ready-built PC or any required component is unavailable, delayed, discontinued or subject to a supplier price change, KIBOPC will contact the customer as soon as reasonably practicable to inform them of the situation.

In such cases, KIBOPC may offer one or more of the following options:

an equivalent or upgraded replacement component;
a revised estimated completion or delivery timeframe;
a revised quotation where supplier pricing has changed before contract formation;
cancellation of the order with a refund where applicable.

KIBOPC will not proceed with a materially different specification without customer approval.

5.9 Component Brand and Model Substitution

Component brands, product revisions and specific models shown on the website may be examples based on the advertised specification. Some components may be selected by specification, performance class or category rather than exact brand. Due to supplier stock, manufacturer availability, product revisions or discontinuation, KIBOPC may supply an equivalent component from a different reputable brand.

KIBOPC uses only well-known and reputable component brands. The final brand or model may vary depending on supplier stock and availability, provided that the selected component offers equivalent or better functionality, reliability, compatibility and core specifications.

KIBOPC will not knowingly substitute a component with a lower performance class or materially inferior specification without customer approval.

Where a substitution would materially affect performance, appearance, warranty, price, delivery time or a key specification, KIBOPC will contact the customer before proceeding.

Section 06

Prices, Quotations and Availability

+

6.1 Prices

All prices are displayed in Euro (€), unless otherwise stated.

6.2 VAT

Prices shall state whether VAT is included, where applicable. If KIBOPC is not VAT registered, this shall be indicated where appropriate.

6.3 Quotations

Unless otherwise stated in writing, quotations are valid for 7 days from the date of issue. After that period, prices and availability may change.

6.4 Component Price Fluctuations

Computer components may be subject to price changes due to supplier pricing, exchange rates, shortages or manufacturer availability. KIBOPC reserves the right to revise quotations before the customer accepts them.

6.5 Errors in Pricing

If an obvious pricing error occurs, KIBOPC is not obliged to supply goods or services at the incorrect price. Where an error is identified after payment but before Dispatch Confirmation, KIBOPC may offer the customer the option to proceed at the correct price or cancel the order and receive a refund.

Section 07

Payment

+

7.1 Accepted Payment Methods

KIBOPC accepts payment through the payment methods displayed on the website or otherwise confirmed in writing.

7.2 Stripe Payment Processing

All online card transactions are processed securely through Stripe, a third-party payment processor. KIBOPC does not collect, view, process or store full credit card or debit card details on its own website or local systems.

7.3 Payment Data

When you make a payment, your payment details are provided directly to Stripe and are processed in accordance with Stripe’s own security, privacy and compliance arrangements.

7.4 Payment Authorisation

Payment authorisation or receipt of funds does not, by itself, constitute acceptance of your order. A contract is formed only in accordance with Clause 5.4.

7.5 Deposits

For custom-built PCs, special orders, repairs or services, KIBOPC may request a deposit or full payment in advance. Deposits for custom or special-order items may be non-refundable once parts have been ordered, work has commenced or the goods have been customised, subject always to applicable consumer law.

7.6 Failed or Reversed Payments

If payment fails, is reversed, charged back or suspected to be fraudulent, KIBOPC may suspend fulfilment, withhold delivery, cancel the order or seek recovery of any outstanding amount.

Section 08

Delivery, Collection and Risk

+

8.1 Delivery Area

KIBOPC delivers to addresses within Ireland only, unless otherwise agreed in writing.

8.2 Delivery Charges

Delivery charges, where applicable, will be displayed during the order process or stated in the quotation or invoice.

8.3 Delivery Times

Delivery dates and timeframes are estimates only, unless expressly guaranteed in writing. KIBOPC shall use reasonable efforts to deliver within the estimated timeframe but shall not be liable for delays caused by suppliers, couriers, customs, strikes, weather, force majeure events or other circumstances beyond its reasonable control.

8.4 Dispatch Confirmation

When your order is dispatched, or ready for collection where applicable, KIBOPC will send a Dispatch Confirmation email.

8.5 Risk

Risk in the goods passes to the customer when the goods are delivered to the address provided by the customer or collected by the customer or their authorised representative.

8.6 Ownership

Ownership of goods passes to the customer only when KIBOPC has received full cleared payment for the goods and any applicable delivery or service charges.

8.7 Incorrect Delivery Information

The customer is responsible for providing accurate delivery information. KIBOPC is not responsible for failed delivery, delay or additional delivery charges caused by incorrect or incomplete customer details.

Section 09

Click and Collect / Local Collection

+

9.1 Collection Arrangements

Where collection is offered, KIBOPC will notify the customer when the goods are ready for collection.

9.2 Identification

KIBOPC may request proof of identity, order confirmation or payment confirmation before releasing goods.

9.3 Failure to Collect

If the customer fails to collect goods within 14 days of notification, KIBOPC may charge reasonable storage fees or cancel the order, subject to applicable law and the nature of the goods.

Section 10

Custom-built PCs and Custom-made Goods

+

10.1 Customer Specification

Where a customer orders a Custom-built PC, the customer is responsible for reviewing and approving the specification before work begins.

10.2 Custom-made Nature

Custom-built PCs are assembled, configured or modified according to the customer’s specific requirements. They may include individually selected components, case design, storage configuration, cooling solution, operating system setup, performance requirements or other personalised elements.

10.3 Changes After Approval

Once the customer has approved the specification and KIBOPC has ordered components or begun assembly, the customer may not cancel or change the configuration unless KIBOPC agrees in writing.

10.4 Availability of Components

If an agreed component becomes unavailable, KIBOPC will contact the customer to agree a suitable replacement, refund the unavailable component or cancel the order where necessary.

10.5 Performance Expectations

KIBOPC will use reasonable skill and care when advising on and assembling custom systems. However, performance may vary depending on software, drivers, games, workloads, ambient temperature, user settings and future updates.

Section 11

Services

+

11.1 Standard of Service

KIBOPC will provide services with reasonable skill and care, in accordance with applicable Irish consumer law.

11.2 Diagnostics

Diagnostic services identify likely causes of faults based on available information and reasonable testing. Some faults may be intermittent or may require further investigation.

11.3 Customer Equipment

Customers must ensure that equipment provided to KIBOPC for repair or service is lawfully owned by them or that they have authority to request the service.

11.4 Data Backup

Before providing any device to KIBOPC for repair, upgrade, installation, diagnostics or configuration, the customer is responsible for backing up all data. KIBOPC is not responsible for loss, corruption or deletion of data except where such liability cannot be excluded under applicable law.

11.5 Software and Licences

The customer is responsible for ensuring that they hold valid licences for any software, operating systems, applications, games or digital content installed or configured on their device, unless KIBOPC expressly supplies such licence as part of the order.

11.6 Service Packages, Shipping and Return of Customer Equipment

Where a customer purchases a service package that requires physical access to a computer, component or device, the customer is responsible for arranging and paying for delivery or shipment of the equipment to KIBOPC, unless otherwise agreed in writing.

KIBOPC will begin the selected service only after the relevant equipment has been received, the service request has been accepted, and any required payment has been received.

The customer is responsible for ensuring that equipment is packed safely and securely for shipment to KIBOPC. KIBOPC is not responsible for loss or damage occurring during shipment to KIBOPC, unless caused by KIBOPC.

After the selected service has been completed, KIBOPC will arrange return delivery of the serviced equipment to the customer’s provided address at KIBOPC’s cost, unless otherwise stated in writing.

Return delivery paid by KIBOPC applies to standard return delivery within Ireland only, unless otherwise agreed. Any special delivery method, international return delivery, failed delivery, incorrect address, redelivery fee or additional courier charge may be payable by the customer.

Service completion times are estimates only and may depend on parts availability, diagnostics, customer response time, software issues, courier delays or other factors outside KIBOPC’s reasonable control.

Section 12

Customer Obligations

+

12.1 Accurate Information

The customer must provide accurate, complete and up-to-date information when placing an order, requesting a quotation or booking a service.

12.2 Lawful Use

The customer must not request or use KIBOPC goods or services for unlawful, fraudulent, harmful or abusive purposes.

12.3 Access and Credentials

Where services require access to devices, accounts, software or systems, the customer must provide necessary access, passwords or credentials. KIBOPC may refuse to perform services where lawful access cannot be verified.

12.4 Collection of Serviced Equipment

Customers must collect serviced equipment within the agreed period after notification. KIBOPC may charge reasonable storage fees for uncollected equipment after 14 days.

Section 13

Returns, Refunds and Cancellations

+

13.1 Separate Returns Policy

Returns, refunds and cancellations are governed by our separate Returns, Refunds and Cancellation Policy, which forms part of these Terms.

13.2 Consumer Cooling-off Rights

Where applicable, consumer customers purchasing standard ready-made goods online may have a 14-day cooling-off period under EU and Irish consumer law. In general, for online goods purchases, this period runs from the date the goods are received.

13.3 Custom-made Goods Exclusion

The statutory cooling-off right does not generally apply to goods made to the customer’s specifications or clearly personalised, including Custom-built PCs assembled to the customer’s individual requirements.

13.4 Faulty Goods

Nothing in these Terms affects the customer’s statutory rights in respect of faulty goods. In Ireland, consumers have specific remedies where goods are faulty, including short-term termination rights, repair, replacement, price reduction or refund, depending on the circumstances.

Section 14

Warranties

+

14.1 Statutory Rights

Consumers have statutory rights under Irish consumer law. These rights are separate from and not replaced by any manufacturer warranty or commercial guarantee.

14.2 Manufacturer Warranty

14.3 KIBOPC Workmanship

KIBOPC may provide a workmanship warranty for assembly or service work for a period of 90 days, unless otherwise stated in writing.

14.4 Warranty Exclusions

Warranty coverage may not apply where damage or fault is caused by:

misuse, neglect or accidental damage;
unauthorised repair, modification or tampering;
liquid damage, electrical surge or overheating caused by improper use;
software misuse, malware or unauthorised overclocking;
failure to follow manufacturer or KIBOPC instructions;
normal wear and tear.

14.5 Return for Inspection

Before any warranty remedy is offered, KIBOPC may require inspection, diagnostic testing or confirmation from the relevant manufacturer or supplier.

Section 15

Limitation of Liability

+

15.1 No Exclusion of Mandatory Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability that cannot be excluded under Irish or EU consumer law.

15.2 Consumer Statutory Rights

Nothing in these Terms excludes, restricts or limits any statutory rights or remedies available to consumers under applicable law. Under the Irish Consumer Rights Act 2022, a trader cannot exclude or restrict certain statutory obligations relating to conformity and other consumer rights.

15.3 Indirect Loss

Subject to Clause 15.1 and applicable law, KIBOPC shall not be liable for indirect, incidental, special or consequential loss, including loss of profit, loss of business, loss of revenue, loss of opportunity, loss of goodwill or loss of anticipated savings.

15.4 Data Loss

Subject to applicable law, KIBOPC shall not be liable for loss, corruption or deletion of data, files, software, images, documents, business information or other digital content where the customer has failed to maintain an adequate backup.

15.5 Maximum Liability

Subject to Clause 15.1 and applicable law, KIBOPC’s total liability arising out of or in connection with any order, goods or services shall not exceed the total amount paid by the customer to KIBOPC for the specific goods or services giving rise to the claim.

15.6 Customer Use of Goods

KIBOPC is not responsible for loss or damage caused by the customer’s misuse, incorrect installation, unauthorised modification, incompatible components, third-party software, malware, overclocking, improper storage or use contrary to instructions.

Section 20

Force Majeure

+

20.1 Events Outside Reasonable Control

KIBOPC shall not be liable for delay or failure to perform obligations where such delay or failure results from events outside its reasonable control, including but not limited to supplier shortages, courier delays, strikes, natural disasters, fire, flood, pandemic, government restrictions, cyber incidents, power failures or telecommunications failures.

20.2 Effect of Force Majeure

Where a force majeure event occurs, KIBOPC will use reasonable efforts to minimise delay and will notify the customer where practicable.

+

21.1 Right to Update

KIBOPC may update these Terms from time to time to reflect changes in law, business practices, technology or website functionality.

These Terms, together with any applicable quotation, invoice, order confirmation, service agreement and policy documents, constitute the agreement between KIBOPC and the customer.
